These Terms and Conditions ("Terms") govern your use of the homebitcoinminers.com.au website and your purchase of goods from Home Bitcoin Miners ("we", "us", "our"). By accessing the website or purchasing goods, you agree to be bound by these Terms.

1. Australian Consumer Law (ACL)

Nothing in these Terms attempts to modify or exclude the conditions, warranties and undertakings, and other legal rights, under the Australian Competition and Consumer Act 2010. Our goods come with guarantees that cannot be excluded under the ACL. However, to the maximum extent permitted by law, our liability is limited to the replacement or repair of the goods, or the refund of the purchase price, at our sole discretion, provided the goods have been used strictly in accordance with our Operating Guidelines.

2. Assumption of Risk (Financial & Regulatory)

Purchasing cryptocurrency mining hardware involves significant financial risk. By purchasing from us, you acknowledge and agree that:

  • No Profit Guarantee: We make no representations, warranties, or guarantees regarding the profitability, Return on Investment (ROI), or yield of any hardware.

  • Network Volatility: Network difficulty, coin price volatility, algorithm changes, and halving events are entirely outside our control and do not constitute a defect in the hardware.

  • Regulatory Risk: We are not liable for any future local, state, or federal laws that may ban, restrict, or tax cryptocurrency mining or energy consumption.

3. Strict Operating Parameters & Warranty Voidance

Bitcoin miners are specialized industrial equipment, not standard consumer electronics. Any deviation from the manufacturer’s specified operating environment constitutes abnormal, unintended, and negligent use, which immediately voids any voluntary warranty and disqualifies the item from ACL "acceptable quality" claims.

You must strictly adhere to the following:

  • Firmware: Hardware must run on official, factory-provided firmware. The installation of third-party firmware, auto-tuning software, or "no-fee" firmware strictly voids all warranties.

  • Overclocking: Operating the machine at voltages, frequencies, or hash rates above the factory default settings is strictly prohibited.

  • Environmental Controls: Devices must be operated in a clean, dust-filtered environment with an ambient temperature strictly between 5°C and 35°C, and non-condensing humidity levels between 10% and 90%.

  • Physical Intervention: Opening the casing, breaking factory seals, attempting self-repair, or modifying the heat sinks/fans voids all warranties.

4. Electrical Safety & Fire Hazard Exclusions

Mining hardware draws massive amounts of continuous electrical current.

  • Licensed Installation Required: You acknowledge that plugging multiple miners into standard residential circuits is a severe fire hazard. You are solely responsible for ensuring your electrical infrastructure is assessed and upgraded by a licensed electrician prior to operation.

  • Liability Release: To the maximum extent permitted by law, Home Bitcoin Miners accepts zero liability for any property damage, fire, electrical fires, melted components, or personal injury resulting from overloaded circuits, power surges, or improper electrical installation.

5. Limitation of Consequential Loss

To the maximum extent permitted by law, Home Bitcoin Miners shall not be liable for any indirect, incidental, special, or consequential damages. This explicitly excludes liability for:

  • Lost profits, lost revenue, or lost cryptocurrency (e.g., Bitcoin) due to hardware downtime, defects, or shipping delays.

  • Losses resulting from mining pool connectivity issues, internet outages, or hacking/malware incidents.

  • Costs associated with electrical consumption, cooling, or facility leasing.

6. Pre-Orders and Batch Delays

If an item is purchased as a "Pre-Order" for a future factory batch:

  • Estimated Delivery Dates (EDAs) are provided by the manufacturer and are subject to change.

  • We are not liable for delays caused by factory production issues, global supply chain disruptions, or Australian Customs holds.

  • Pre-orders are final and cannot be cancelled due to manufacturer delays or changes in mining profitability during the waiting period.

7. Diagnostic & Forensic Testing

In the event of a warranty or ACL claim, Home Bitcoin Miners reserves the right to subject the returned hardware to comprehensive forensic diagnostic testing. If log files, kernel logs, or physical inspection reveal evidence of overheating, overclocking, custom firmware, or electrical surges, the claim will be denied, and the customer will be liable for a diagnostic fee and all return shipping costs.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts in Victoria.
